- The company Liberalex and/or its representatives take reasonable precautions to maintain, as much as possible, user privacy and the confidentiality of information.
- It is clarified that since activities are carried out in an online environment, the company cannot guarantee complete immunity against breaches or unauthorized exposure of information by illegal actions. Therefore, if a third party manages to gain access to the information stored by the company, the user will have no claims, demands, or lawsuits against the company.
- Likewise, in cases resulting from force majeure, the company will not be responsible for any damage of any kind, whether direct or indirect, caused to the user or anyone acting on their behalf, if any information provided is lost, reaches a hostile entity, and/or is used without authorization. The company undertakes not to use registered users’ details except as specified in these terms and for the purpose of maintaining contact with the user.
- The company will not provide user details, except in any of the following cases:
(a) if required to do so by a judicial order or by law;
(b) if it receives a legal warning of proceedings against it due to actions performed by the user, or in any dispute, claim, demand, or legal proceedings, if any, between the user and the company;
(c) if the company organizes its activities under another entity, or in the event of a merger with another entity or combining its activities with those of another entity – the company will have the right to transfer the user’s details to the aforementioned entity, provided that the latter accepts this privacy policy;
(d) if a claim arises or suspicion occurs that the user performed an act and/or omission that harms and/or might harm the company and/or its representatives and/or any third parties;
(e) if a claim arises or suspicion occurs that the user used the service to perform an illegal act and/or to enable, facilitate, assist, and/or encourage such an act;
(f) if a claim arises or suspicion occurs that the user violated one of the terms of this policy and/or any agreement with the company and/or its representatives;
(g) if required for the company’s activities, such as transferring details to employees, subcontractors, and other entities involved in or partnered with the company’s marketing activities. Users will have no claim or demand against the company regarding the disclosure of their details as stated, and they hereby waive any such claim and/or demand. - Registering and providing details by the user constitutes the user’s consent that their details and any data generated from analyzing these details, along with any information about them obtained or that will be obtained by the company, will be stored in one or more of the company’s databases or its representatives, and that this information will be used for the following purposes:
(a) for marketing, advertising, promotion, and sales purposes, as well as for contacting the user in any way, including direct mail through any communication means deemed appropriate (including written, print, phone, text message, fax, computerized, or any other method);
(b) to encourage loyalty, perform statistical analysis and research, conduct surveys, and for any other online use related to marketing;
(c) for internal purposes, such as handling complaints and/or reviews; and
(d) for sending marketing and advertising material, including through the use of “Cookies.” Such use of user details will not be considered a violation of privacy. It is further agreed that such information will be considered the company’s property, and the user hereby waives any claims regarding the use and/or ownership of this information, including any claims under the Protection of Privacy Law, 1981. The company will not be considered to have violated a privacy obligation or infringed user privacy due to any information, as defined in the Computer Law, 1995, that could identify or track a user by others and arises from the use of electronic communication means in general and computer communication in particular. - It is clarified that the company may share users’ personal information with service providers performing services on the company’s behalf, based on its instructions. The company does not authorize these service providers to use or disclose the information except as necessary to perform services on its behalf or comply with legal requirements. Examples of such service providers include entities processing credit card payments, fulfilling orders, and providing server hosting and direct marketing services. These providers are required to maintain the confidentiality of the information.
- The user’s personal details (name, email, etc.) will be stored in the company’s database and will be used, among other purposes, for direct mail. To unsubscribe, please contact the company’s customer service via email at support@liberalex.com. For the avoidance of doubt, the company will still be entitled to use user details for the purposes detailed in Section 5 above, subject to maintaining user privacy and in accordance with applicable law.
- It is hereby clarified that the company may receive personal information about the user from various sources. The company may collect this information when the user provides it on the company’s website, on its social media platforms, or at one of its events. When a user visits this website, the company also collects certain information through automated means using technologies such as cookies, web server logs, and web beacons.
- The user acknowledges that they are not legally obligated to provide their details and that providing this information is done voluntarily and with their consent. The user expressly agrees to the aforementioned use of the details they provided and confirms that such use will not be considered a violation of privacy, nor will it entitle them to any relief and/or compensation.
- Consent to receive promotional material means joining the website’s mailing list – separate from the network stores’ mailing list. Therefore, a request to unsubscribe from the mailing list will apply only to the website’s mailing lists.
